Ohio Maximum Compensation Cap

In Ohio, damages are determined into three general parts such as:
- Non-Economic Damages

The first two mentioned type of damage are both compensatory damages which means they are applied to at-fault driver intended to make compensation to the injury party while punitive damages are non-compensatory or called oftentimes exemplary damages. In cases of injury and medical malpractice, all forms of economic damages have no compensation cap since these are measurable by calculated monetary losses and are only limited by the amount or value of the claim that is issued to recover. But, on the punitive damages and non-economic damages, they don’t have cap since they are not measurable by monetary cover and it is subjective.
What are the Ohio Damage Caps?
According to Ohio’s law, the monetary compensation limit of non-economic damages is $250,000 or up to three times to the value of calculated economic damages or which holds greater value, it includes the loss of quality of life, lost of a guardian and companion, pain, suffering, and loss of enjoyment. It ignores how high the economic damages are and is limited to a maximum of $350,000 per plaintiff or $500,000 per incident whereas punitive damages are limited to the twice amount of compensatory damages that is given to the case.
